Technical Help
By using the Contractor’s A/V.com Technical Help service, you are indicating
your agreement to be bound by the following Terms of Service:
1. Availability of Services
Contractor’s A/V.com’s telephone support services and online technical support
services (collectively, the “Customer Services”) are available only
to “Customers” or potential “Customers” of Contractor’s
A/V.com. Telephone support is only available through the phone number indicated
for such, and is not available through the toll-free number. Telephone support is
available to a Customer calling from within the continental United States only,
and must be directly related to products purchased or to be purchased from Contractor’s
A/V.com.
Contractor’s A/V.com technical support is NOT unlimited, and will typically
allocate up to a maximum of 10 minutes per call or as deemed necessary by Contractor’s
A/V.com, after such time or for multiple requests for the same issue(s), the call
may be referred to the manufacturer of the relevant product(s) for further technical
support.
2. Supported Products and Technology
The Customer Services may include telephone support services and online technical
support documents. As new technology, products, etc. become generally available,
Contractor’s A/V.com will use its best efforts to offer information on such.
Contractor’s A/V.com is not knowledgeable with all products, technologies, etc.,so
information may not be available for all products sold or represented.
Contractor’s A/V.com offers general technical “Help” only. Contractor’s
A/V.com will not be responsible for knowing all features of all products. Some products
may be preferred by CAV to use as a technical reference. Any information given will
be of a general nature and is intended only as an information aide, but not as a
solution.
Contractor’s A/V.com does not represent or endorse the accuracy or reliability
of any of the information, content or advertisements (collectively, the “Materials”)
contained on, distributed through, or linked, downloaded or accessed from any of
the services contained on Contractor’s A/V.com’s, nor the quality of any
products, information or other materials displayed, purchased, or obtained by you
as a result of an advertisement or any other information or offer in or in connection
with the the products of Contractor’s A/V.com. You hereby acknowledge that any
reliance upon any Materials shall be at your sole risk. Contractor’s A/V.com
reserves the right, in their sole discretion and without any obligation, to make
improvements to, or correct any error or omissions in any portion of the information,
either by telephone, fax, e-mail, etc., or the Materials.
THE SERVICE AND THE MATERIALS ARE PROVIDED BY CONTRACTOR’S A/V.COM ON AN “AS
IS” BASIS CONTRACTOR’S A/V.COM EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES,
EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY AND
FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SERVICE OR ANY MATERIALS AND
PRODUCTS. IN NO EVENT SHALL CONTRACTOR’S A/V.COM BE LIABLE FOR ANY DIRECT, INDIRECT,
INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER WITH RESPECT
TO THE INFORMATION, SERVICE, THE MATERIALS AND THE PRODUCTS.
Contractor’s A/V.com, its agents and employees will not be liable for any loss
or damage arising directly or indirectly from the possession, publication or use
of or reliance on information obtained from Contractor’s A/V.com as it is provided
in good faith without express or implied warranty.
Contractor’s A/V.com will use its best efforts to resolve Customers’ basic technical
problems. Contractor’s A/V.com will attempt to resolve such technical problems
in a professional, reasonable and timely manner, taking into consideration the circumstances
and nature of the technical problems, questions, etc., live and online response
times may be delayed due to research and inquiries, as may be necessary. Contractor’s
A/V.com live or online technical support does not assure that every request for
technical support will be resolved to Customer’s satisfaction, Contractor’s
A/V.com responses constitute only technical advice or suggestions. Technical problems
that may arise may not be correctable or may be too difficult to resolve by telephonic
or online support. Contractor’s A/V.com has limited proprietary information
from vendors, manufacturers, and developers, and may not have the ability to obtain
any proprietary information necessary to resolve Customer’s technical problem.
4. Customer’s Responsibilities
Customer is responsible for providing Contractor’s A/V.com with complete information
concerning each issue or problem, and for notification by e-mail. Prior to seeking
technical support, Customer is solely responsible for applicable and adequate knowledge
of tools, technicques, safety issues, etc.. Customer shall not provide Customer’s
password or identification number to any third person or permit its use by any third
person. Customer understands and acknowledges that neither Contractor’s A/V.com
nor any of its third-party product or service providers shall be responsible for
any lost time, compensation, or work delays, etc. resulting from any technical support
services, other services, or products provided by Contractor’s A/V.com.
5. Third-Party Link and Content Disclaimer
Links contained in Contractor’s A/V.com ’s website may cause a user to leave
the Contractor’s A/V.com website. Such linked websites are not under the control
of Contractor’s A/V.com and Contractor’s A/V.com is not responsible for
the contents of any linked website or any link contained in a linked website, or
any changes or updates to such websites. Contractor’s A/V.com provides these
links from the Contractor’s A/V.com website only as a convenience, and the inclusion
of any link does not imply any endorsement by Contractor’s A/V.com of the website
or any of its contents. All users use materials and information in third-party websites
at their own risk.
6. Third-Party Privacy Practices
All use of the Customer Services and the Contractor’s A/V.com website is subject
to Contractor’s A/V.com Privacy Policy, which may be reviewed by clicking here
or on the appropriate link at the bottom of this page. Though Contractor’s A/V.com
promotes responsible privacy policies, Contractor’s A/V.com cannot control or
be responsible for the privacy practices of third-party websites or service providers
to which the Contractor’s A/V.com website contains links, or for the privacy
practices of providers of software or other repair services or products that are
available from the Contractor’s A/V.com or Customer plan.
7. Customers Non-Transferable
Contractor’s A/V.com Customers, and all rights of Customers to receive Customer
Services, are non-transferable.
8. NO WARRANTIES
CONTRACTOR’S A/V.COM’S Customer SERVICES, THE CONTRACTOR’S A/V.COM WEBSITE
(INCLUDING ALL INFORMATION AND PRODUCTS THAT ARE REFERENCED OR LINKED TO IN THE
CONTRACTOR’S A/V.COM WEBSITE), AND ALL OTHER INFORMATION, DOCUMENTS, PRODUCTS,
SOFTWARE, DOWNLOADS, REPAIR SERVICES, ADVICE, AND INFORMATION PROVIDED BY CONTRACTOR’S
A/V.COM AND ANY OF ITS THIRD-PARTY PRODUCT OR SERVICE PROVIDERS ARE PROVIDED “AS
IS” AND WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS, IMPLIED OR STATUTORY,
INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTIBILITY, FITNESS FOR
A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. CONTRACTOR’S A/V.COM ASSUMES NO RESPONSIBILITY
FOR ANY ERRORS, OMISSIONS OR OTHER INADEQUACIES IN THE Customer SERVICES, THE CONTRACTOR’S
A/V.COM WEBSITE (INCLUDING ALL INFORMATION AND PRODUCTS THAT ARE REFENCED OR LINKED
TO IN THE CONTRACTOR’S A/V.COM WEBSITE), OR ANY OTHER INFORMATION, DOCUMENTS,
PRODUCTS, SOFTWARE, DOWNLOADS, REPAIR SERVICES, ADVICE, AND INFORMATION PROVIDED
BY CONTRACTOR’S A/V.COM OR ANY OF ITS THIRD-PARTY PRODUCT OR SERVICE PROVIDERS.
9. LIMITATION OF LIABILITY
IN NO EVENT SHALL CONTRACTOR’S A/V.COM BE LIABLE TO ANY PERSON FOR ANY SPECIAL,
GENERAL, INCIDENTAL, INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING,
WITHOUT LIMITATION, THOSE RESULTING FROM NEGLIGENT OR CRIMINAL ACTS OF THIRD PARTIES,
LOSS OF USE, LOSS OF DATA, LOST PROFITS, OR OTHER DAMAGE, IN CONNECTION WITH ANY
OF THE Customer SERVICES, THE CONTRACTOR’S A/V.COM WEBSITE (INCLUDING ALL INFORMATION,
SERVICES, AND PRODUCTS THAT ARE REFERENCED OR LINKED TO IN THE CONTRACTOR’S
A/V.COM WEBSITE), OR ANY OTHER INFORMATION, DOCUMENTS, PRODUCTS, SOFTWARE, DOWNLOADS,
REPAIR SERVICES, ADVICE, AND INFORMATION PROVIDED BY CONTRACTOR’S A/V.COM OR
ANY OF ITS THIRD-PARTY PRODUCT OR SERVICE PROVIDERS, WHETHER SUCH PERSON IS ADVISED
OF THE POSSIBILITY OF SUCH DAMAGES.
10. Force Majeure
In the event Contractor’s A/V.com’s delivery of the Customer Services is delayed,
prevented, or otherwise made impracticable by reason of any acts of God, fires,
floods, earthquakes, or other natural catastrophes; national emergencies, strikes,
lockouts or other labor difficulties; computer “hacking” attack or computer
virus; any law, order, regulation or other action of any governing authority; or
any other cause beyond Contractor’s A/V.com’s reasonable control, then Contractor’s
A/V.com shall be excused from such delivery to the extent that it is delayed or
prevented by such cause.
11. Modifications to Terms of Service
Contractor’s A/V.com reserves the right to amend the Terms of Service that govern
use of the Customer Services and the Contractor’s A/V.com website at any time
by (a) posting a revised version of the Terms of Service on the Contractor’s
A/V.com website , or by (b) sending information regarding any amendment to the Terms
of Service to the email address Customer provides to Contractor’s A/V.com. Customer
is responsible for regularly reviewing the Contractor’s A/V.com website to be
notified of any amendments to the Terms of Service. Customer’s continued use of
the Customer Services after such amended Terms of Service have been posted or information
regarding such amended Terms of Service has been sent to Customer shall be deemed
acceptance by Customer of the amended Terms of Service.
12. Fair Usage Policy; Suspension or Termination of Customers
Contractor’s A/V.com is meant only for customers or potential of Contractor’s
A/V.com. Though Contractor’s A/V.com has set no fixed upper limit on the amount
of telephone or online support requests a Customer may make annually, each Customer’s
use of the Customer Services is subject to Contractor’s A/V.com’s “Fair
use” policy. Under this policy, if at any time, in Contractor’s A/V.com’s
sole discretion, Customer’s use exceeds the level of use reasonably expected from
a customer of Contractor’s A/V.com, then Contractor’s A/V.com reserves the
right to suspend or terminate Customer’s Customer Services. In addition, Contractor’s
A/V.com reserves the right to suspend or terminate any Customer Services of any
Customer that Contractor’s A/V.com, in its sole discretion, determines are being
used (a) fraudulently, (b) by any person other than Customer, or (c) for any person
that is not a customer.
13. General
In addition to the Terms of Service, Customer agrees to be bound by the Privacy
Policy and all other legal notices contained on the Contractor’s A/V.com website,
which collectively constitute the entire agreement between Customer and Contractor’s
A/V.com. Contractor’s A/V.com and/or third party providers may make improvements
and/or changes in the products, services, programs, business or customer policies
and prices described in their websites at any time without notice. California law
will govern any action related to the Terms of Service, without regard to conflict
of law principles. The Terms of Service shall be construed as if it was executed
and performed in Los Angeles, California. Any cause of action by a Customer or other
viewer of this website must be commenced within one (1) year after the cause of
action arose or it shall be forever waived and barred. If any provision of the Terms
of Service be held invalid or unenforceable, that portion shall be enforced to the
maximum extent possible, and all other provisions contained in the Terms of Service
shall remain in full force and effect. Contractor’s A/V.com’s failure to enforce
any provision of the Terms of Service shall not be deemed a waiver of such provision
nor of the right to enforce such provision. The Contractor’s A/V.com website
is available internationally and may contain references to Contractor’s A/V.com
products, services, and programs that are not available in a viewer’s country. These
references do not imply that Contractor’s A/V.com intends to make such products,
services, or programs available in such country.
